Judge Tia Fisher on Thursday admitted into evidence a statement from Eliezer Reyes saying that Carlos Chavira was not a member a gang called the Townsmen.
Chavira, a former Marine and Iraq war veteran, has been charged with murder and two counts of attempted murder in the Feb. 10, 2009 shootout that killed 19-year-old Walter Zomoza.
Zomoza sustained a fatal gunshot wound just below his neck in the gunfight at a Chevron gas station at La Puente Road and Nogales Street in Valinda.
Reyes and Zomoza were members of a Valinda street gang called the East Side Dukes, which fueds with the Townsmen."
