Michael Dewayne Smith, 29, and Jim Flint McIntyre, 42, along with Frank Lavelle Urbish, Jr., 38, of Beaumont, are accused in the May 2008 death of Mark Davis Byrd.
Urbish, Smith and McIntyre are all members of the Aryan Brotherhood of Texas gang. Byrd, 28, a prospective member, was killed after gang leaders suspected him of stealing drugs that he was told to deliver to a customer on behalf of the gang, officials said.
Urbish, known as Thumper to other gang members, ordered Smith and McIntyre, known as Bucky and Q-Ball, to carry out the murder, officials said. Byrd's body was discovered May 4, 2008 in Atascosa County, south of San Antonio, federal officials said.
All three have been charged with conspiracy to commit murder, murder and being a felon in possession of a firearm. Smith and McIntyre also are accused of multiple weapons charges in connection with the slaying, officials said.
They are expected to appear July 7 before a federal magistrate in San Antonio and could face life in prison or the death penalty, officials said.
